02 · Agreement
Scope and mandatory rights
These terms apply to consumer purchases of leather goods through the Agafia website and online sales service. They are supplemented by the final proposal accepted for a specific order and by mandatory Finnish and European consumer-protection law.
Nothing in these terms limits a consumer right that cannot legally be excluded or restricted. If a translated version is provided later, the version supplied with the accepted proposal will govern to the extent permitted by law.
03 · Made-to-order
How a request becomes an order
- You select a product, variant and available customisation and send an order request.
- The first request is not a payment and does not create an obligation to pay.
- Agafia may clarify colour, monogram, dimensions, availability, delivery and timing with you in the order chat.
- Agafia sends a final proposal showing the agreed specifications, product price, delivery price, total amount and estimated production time.
- You may accept the proposal by choosing Pay now and completing payment through Stripe before the proposal expires.
- The sales contract is concluded when the accepted payment is confirmed. An order confirmation is then provided by email and in your account.
Agafia may decline a request before payment if materials, production capacity or the requested specification are unavailable. You may abandon an unpaid request without charge.
04 · Natural materials
Products and customisation
Leather is a natural material. Grain, small marks, tone and texture may vary from photographs and between pieces. Colour also varies with lighting and screen settings. These expected characteristics are not defects when the product otherwise matches the agreed description.
Before paying, check the final proposal carefully. You are responsible for confirming monogram spelling, measurements and other instructions. Agafia remains responsible for making the product according to the accepted proposal and applicable consumer law.
05 · Total amount
Prices and payment
- Prices are stated in euros.
- The final proposal shows the product price, delivery charge, applicable taxes and total amount payable before payment.
- Delivery is quoted individually because parcel size, weight and destination affect the available Finnish carrier price.
- No additional paid item is added without your express agreement.
- Payment is processed through Stripe. Agafia does not receive or store complete card details.
If a displayed price is clearly incorrect, Agafia will correct it in the final proposal before payment. A price cannot be changed after the proposal has been accepted and paid unless both parties expressly agree to a requested change.
06 · Timing and parcel
Production and delivery
Production begins after payment is confirmed. The estimated production period and delivery method are shown before payment. Because each piece is made by hand, an estimate is not a guaranteed delivery date unless a specific date has been expressly agreed in writing.
Agafia will notify you of a material delay. If delivery does not take place within an agreed time or an appropriate additional period required by applicable law, you may have the right to terminate the contract and receive a refund.
Orders are sent to the address confirmed in the final order. Tracking is provided when available. Risk of loss or damage normally passes to you when you or a person nominated by you receives the goods, except where mandatory law provides otherwise.
07 · Cooling-off period
Withdrawal and returns
Standard goods
Consumers normally have 14 days from receipt of standard goods to notify Agafia of withdrawal without giving a reason. Notice may be sent to agafiagrace@gmail.com and should include your name, order number, the goods concerned and a clear statement that you wish to withdraw.
Goods must be returned no later than 14 days after notice to: Mariia Karnaukh, Minivägen 3 A 3, 66950 Munsala, Finland. Unless Agafia agrees otherwise or the return concerns a defect, you bear the direct cost of ordinary return postage. Keep proof of dispatch.
Refunds are made without undue delay and no later than 14 days after the withdrawal notice, using the original payment method. Agafia may withhold the refund until the goods are received or you provide proof of return. The refund includes the price and the cost of the least expensive standard delivery offered for the order. Extra cost of a more expensive delivery choice is not refundable unless required by law.
You may examine a product as you could in a shop. You may be responsible for diminished value caused by handling beyond what is necessary to establish its nature, characteristics and functioning.
Genuinely personalised goods
The statutory right of withdrawal does not apply to goods made or modified to your individual specifications or clearly personalised for you—for example, a monogram, individually supplied measurements or a unique specification that prevents normal resale. Selecting a standard model, standard colour or ordinary catalogue option does not by itself automatically remove the right of withdrawal.
Agafia will identify any personalisation that removes the withdrawal right before payment. This exception never limits your statutory rights if the item is defective or does not match the accepted proposal.
08 · If something is wrong
Defects, transport damage and complaints
Inspect the parcel after delivery and contact Agafia within a reasonable time after discovering a problem. Include the order number, a description and clear photographs where useful. Reporting quickly helps preserve carrier evidence, but does not remove statutory rights.
Agafia is liable for defects under mandatory consumer law. Depending on the circumstances, the available remedy may include repair, replacement, price reduction or cancellation and refund. Agafia bears reasonable return costs for a confirmed defect or incorrect item.
Complaints may be sent to agafiagrace@gmail.com or through the chat attached to the relevant order.
09 · Fair limits
Liability
Agafia is not responsible for delay or failure caused by an event outside reasonable control, but will communicate the effect and take reasonable steps to reduce it. Nothing in these terms excludes liability for intent, gross negligence, personal injury, statutory product liability or another liability that cannot legally be limited.
Consumers retain all remedies available under mandatory law. Any liability limitation is interpreted only to the extent permitted by that law.
10 · Resolution
Governing law and disputes
These terms are governed by Finnish law. A consumer also retains any mandatory protection granted by the law of their habitual country of residence. Disputes should first be raised directly with Agafia in writing.
If no agreement is reached, consumers may contact the Finnish Consumer Advisory Services and may submit the matter to the Finnish Consumer Disputes Board. The Board requires the consumer to have complained to the seller first. A consumer may also use a competent court and any cross-border assistance available under applicable law.
11 · Current version
Changes to these terms
The terms applicable to an order are the terms provided or made available when its final proposal is accepted. Later updates apply only to future orders unless a change is required by mandatory law or expressly agreed.
